Photography Session Agreement

PHOTOGRAPHY SESSION AGREEMENT

This Photography Session Agreement is entered into between Heart & Frame Photography, operated by Gabriela Yurkowski, hereafter referred to as the “Photographer,” and the Client submitting the form below.

By submitting the session agreement form and signing digitally, the Client acknowledges that they have read, understood, and agreed to the terms outlined below.

Session Fee & Retainer

A non-refundable retainer fee is required to reserve the session date and time. No session is considered booked until the retainer payment has been received.

The remaining session balance must be paid no later than the scheduled session date, unless otherwise agreed upon in writing.

The session fee covers the Photographer’s time, talent, standard editing, and delivery of a digital gallery containing a minimum of 30 edited images for a one-hour session.

Artistic Style & Image Editing

The Client acknowledges that they are familiar with the Photographer’s portfolio and artistic style.

The Photographer maintains full creative control over the session, including poses, lighting, composition, editing style, and final image selection.

Images delivered will reflect the Photographer’s artistic interpretation and editing style.

Standard editing includes color correction, exposure adjustments, white balance correction, cropping, tonal adjustments, and basic blemish removal.

Advanced retouching (such as removal of tattoos, tan lines, or body modifications) may be available for an additional fee at the Photographer’s discretion.

RAW (unedited) image files will not be provided.
Clients may not apply filters, alter, or digitally manipulate the delivered images.

Event / Birthday Session Coverage

For event-style sessions, including birthday parties, the Photographer will document the event in a candid, documentary style.

While every effort will be made to capture meaningful moments (such as blowing out candles, singing happy birthday, or family interactions), specific moments are not guaranteed unless discussed and agreed upon in advance.

The Client is responsible for informing the Photographer of any important moments or timeline changes during the event.

Due to the nature of live events, factors such as lighting, space limitations, timing, and guest cooperation may affect the final images. The Photographer is not responsible for missed moments beyond their control.

Travel Fees

Sessions include travel within a 30-minute radius of the Photographer’s location.

Locations beyond this distance may be subject to an additional travel fee to cover time and transportation costs. Any applicable fees will be discussed and agreed upon prior to booking.

Location Fees

If the Client selects a location that requires entry fees, permits, or parking fees, those costs are the responsibility of the Client.

The Photographer does not guarantee access to any location chosen by the Client.

Late Arrival Policy

Session time begins at the scheduled start time.

Clients who arrive late may have reduced session time, as sessions cannot be extended if another booking follows.

Late arrival does not result in a refund or rescheduling.

Rescheduling Policy

Sessions may be rescheduled with at least 48 hours’ notice.

Failure to provide adequate notice may result in forfeiture of the retainer.

Rescheduled sessions must take place within 30 days of the original session date, subject to Photographer availability.

Weather Policy

Outdoor sessions may be rescheduled in the event of unsafe weather conditions, including heavy rain, extreme wind, or severe weather warnings.

Weather-related rescheduling decisions are made at the Photographer’s discretion to ensure safety and image quality.

Rescheduled sessions will be arranged at the next mutually available date.

Image Delivery

Edited images will be delivered within approximately three (3) weeks of the session date.

Images will be delivered through an online gallery or digital download link.

The Photographer determines which images are edited and delivered.

Unedited or rejected images will not be provided.

Image Archive Policy

Images will remain available for download for three (3) months after delivery.

After this period, images may be permanently removed from the Photographer’s storage system.

Clients are responsible for downloading and backing up their images once delivered.

The Photographer is not responsible for lost files after the archive period.

Copyright & Usage Rights

All photographs remain the copyright property of the Photographer.

The Client receives a personal-use license, allowing them to download, share on social media, and print images for personal use.

Images may not be sold, altered, edited, or used for commercial purposes without written permission from the Photographer.

Model Release

The Client grants the Photographer permission to use images from the session for portfolio display, website galleries, social media, and marketing materials.

Clients who prefer their images not be used must notify the Photographer in writing prior to the session.

Liability

The Photographer is not responsible for any injuries sustained during the session.

Clients are responsible for their own safety and for supervising any children participating in the session.

Clients are also responsible for ensuring that children and guests do not handle or interfere with the Photographer’s equipment. Any damage caused may result in repair or replacement costs being the responsibility of the Client.

Equipment Failure / Loss of Images

In the unlikely event of equipment malfunction, file corruption, or loss of images beyond the Photographer’s control, liability is limited to a refund of the session fee.

Agreement Confirmation

By submitting the session agreement form and providing a digital signature, the Client confirms that they have read, understood, and agreed to the terms of this Photography Session Agreement.
